COVID-19/Contagious Illness

Infection Prevention and Control Protocol

- A $100 non-refundable, but transferable deposit will be collected. Your time slot will be held upon receipt of this signed contract and deposit. Full payment will be due via EMT, Square, or PayPal either the day prior to, or the day of your session, if everyone is healthy to proceed.

- In light of the recent pandemic, all bookings are considered "tentative" and may be cancelled or rescheduled on short notice as a result of government mandates or changes/worsening in the emergency situation.

- If any individual intended to be photographed displays symptoms of Covid-19 or other contagious illness at any point throughout the session, the session will be cancelled and rescheduled.

SYMPTOMS INCLUDE:
Cough, fever, dizziness, loss of taste or smell, fatigue not caused by lack of sleep, shortness of breath, difficulty breathing, rash or discolouration of fingers or toes, or conjunctivitis.

- If you have pending Covid-19 test results, have tested positive and have not yet been classified as "recovered" OR have had contact with a known positive Covid-19 case in the 14 days prior to your session, please cancel and reschedule to a later date.

POLICY, TERMS, AND CONDITIONS

Retouching of images includes basic editing, colour correction, blemishes, composite image creation, and background extension where correction is needed. It does not include changing of backdrop colours, changing of clothing colours, head swaps, or adding or removing individuals from an image.

If the client is not satisfied with the images or products through negligence or fault of Raindance Photography, the photographer has the discretion to retake the images or provide a partial/full refund. Specific images may be requested and every attempt will be made to create them, however,failure to capture any specifically requested images will not result in partial or full refund of any portion of the fees. Notification of dissatisfaction must be provided by the client in writing within one week of receipt of images or upon receipt of products in order to qualify for replacement or refund. Raindance Photography will do everything necessary and feasible to ensure the satisfaction of the images and products. Raindance Photography will not be responsible or liable for dissatisfaction due to circumstances beyond the photographer's control.

Your session date is not confirmed until this contract and $100 deposit have been received.

Prices are non-negotiable.

Raindance Photography does not release RAW or unedited images in order to protect the integrity of the work.

Selections must be made at the time of your Online Ordering Gallery. Galleries that need to be reinstated if an order is not received after expiry will be charged a $150 reinstatement fee.

INDEMNIFICATIONS

Raindance Photography and Client agree that the photographer is under no obligation to capture any specific moment or pose or person(s) during the session.

Client agrees to indemnify and hold Raindance Photography harmless for any liability, damage, or loss related to technological failure, including data loss.

Client understands and agrees that Raindance Photography is not required to maintain copies of the photos from this session 60 days after the photos have been delivered to the Client.

Client agrees to hold Raindance Photography harmless for any personal injury which may occur during the session. Raindance Photography agrees to never pose clients in a potentially dangerous manner or location, and all precautions necessary will be taken to follow pandemic guidelines, when applicable.

Client agrees that Raindance Photography is not responsible for their choices in wardrobe, any wrinkles in clothing, choice of nail manicure or make up, and understands that dissatisfaction with any of these choices WILL NOT be retouched or changed in post production by the photographer, and will not qualify for a re-shoot.

The sole remedy for any actions or claims resulting from Raindance Photography's inability to deliver the goods and services listed in this contract shall be limited to a refund of monies paid by the Client to the Photographer for this session only.

If subjects are unwilling or uncooperative, Raindance Photography will not be held responsible. The Photographer will do everything possible to attempt to gain subject cooperation, but unsuccessful attempts will not result in refund or reschedule.

TERMS OF PAYMENT

A Retainer Fee ($100) is due at the time of booking via Square, PayPal or Email Money Transfer (EMT) in order to secure your booking. Remainder of package fee is due on or before the session date.

No part of the order, including previews, will be delivered until the balance is paid in full.

Due to the custom nature of the product, payment for any prints or products ordered after your session is complete must be paid in full at the time of ordering (I accept cash, EMT or major credit card).

DELIVERABLES

We will schedule your Online Ordering Appointment approximately 2-3 weeks after your portrait session. After you have placed your order, you will receive your order within 1-4 weeks (some products have a longer in-lab production time).

Raindance Photography reserves the right to extend this time frame in the event of family emergency or personal illness, which would be communicated clearly with the client, should these circumstances arise.

ALL SALES ARE FINAL

COPYRIGHT AND OWNERSHIP

All images are the exclusive property of Raindance Photography and may not be cropped, edited, or be subjected to any further retouching or alteration by anyone other than our Studio. If there are editing errors that you would like corrected, they must be requested at the time of your Online Ordering Appointment. Any corrections requested after this time frame will incur a charge of $60/hour.

Print release is given with the purchase of digital images, however, we strongly suggest that you consider professional quality prints and products in order to maximize the quality of your investment. If you choose to print at a non-professional, consumer accessible lab, we kindly request that you do not print at discount printers such as Walmart. We'd love for you to save your pennies, but we really are passionate about providing you with a great quality product! We are not responsible for the quality (colour/contrast variation) of any prints made at third party labs.

CANCELLATION/RESCHEDULE POLICY

48 hours notice must be given in order to cancel or reschedule.

Retainer Fees are non-refundable, but are transferable to another mutually agreeable date within 12 weeks of the original booking.

Raindance Photography reserves the right to reschedule due to any of the following circumstances:
- Family emergency.
- Contagious illness.
- Weather (for outdoor sessions only)

If Raindance Photography is unable to perform the services in this contract due to any cause outside its control, the Client agrees to indemnify the Photographer for any loss damage or liability, however, the Photographer will return, in full, all payments made by the Client to the Photographer in relation to this session.

Model Release

I hereby grant Raindance Photography the right to use and publish images for purpose of display, editorial work, portfolio, advertising, website or publication to promote Raindance Photography. Behind the Scenes video footage may be captured during sessions and shared for marketing purposes. I agree that these Images and footage can be used by Raindance Photography without any additional compensation to the subjects in the images.
